Proposed OCRM Revised Baseline
and 40- year Setback Line
The Town of Kiawah Island was made aware on Tuesday, March 3, 2009
by a private citizen that the OCRM is proposing revisions to the
baseline and 40-year setback line along the front beach of Kiawah
Island. OCRM failed to notify the Town of the proposed revisions.
The proposed revisions could dramatically affect a large number of
oceanfront properties on Kiawah Island by placing the 40-year
setback line landward of substantial portions of structures, and in
some cases, entire structures.
The proposed revisions could affect the legal rights of a large
number of Kiawah Island oceanfront property owners. The Town has
hired Dr. Tim Kana to assist the Town in objecting to the proposed
revisions. The Town urges all oceanfront property owners on Kiawah
to determine whether the proposed revisions will affect your
property and take whatever steps necessary to protect your
interests. Copies of the aerial photographs depicting the proposed
revisions are available for inspection in Town Hall as well as at
the OCRM office at the address that follows. The OCRM will receive
public comment on the proposed revisions and hold a Public Hearing
on Monday, March 16, 2009 at 6:00 PM at DHEC-OCRM’s Office in
Charleston located at 1362 McMillan Avenue, Suite 400, Charleston,
SC. Public comments will be received up until the Public Hearing and
